Date set for Sportech’s ‘Spot the Ball’ VAT appeal

Pools and sports betting operator Sportech will have to wait until November for its appeal to be heard over a VAT repayment claim on the ‘Spot the Ball’ game.

In a statement, Sportech said its hearing at the UK’s Court of Appeal had been scheduled for the week commencing November 2.

The hearing, which is the latest installment of a legal saga that has run for five years, is expected to take between one and one-and-a-half days.

In 2013, the First-Tier Tribunal ruled in favour of Sportech in a VAT case relating to the game, with the operator receiving a payment of £93 million (€120 million/$140 million) from Her Majesty’s Revenue & Customs (HMRC).

However, this decision was reversed in September when Sportech was ordered to repay the money following an appeal lodged by HMRC.

Sportech was given until October 15 to seek permission to appeal against the decision and was granted that permission last month.
